2. Scope of Service
ALBA offers private boat aperitif experiences and exclusive excursions in the Gulf of Alghero and the Marine Protected Area of Capo Caccia - Isola Piana. Tour details, schedules, and prices indicated as "starting from" are indicative and subject to confirmation depending on availability and marine weather conditions.
3. Bookings and Payments
A booking is considered confirmed exclusively upon express written confirmation by the operator and receipt of the agreed payment (deposit or total balance). Final pricing depends on the number of guests, excursion duration, specific tour format, and any custom catering or extra services requested.
4. Weather Conditions and Safety
Guest safety is our highest priority. The licensed skipper holds sole and indisputable authority to evaluate sea and weather conditions, modify the navigation itinerary, or cancel the excursion if conditions are deemed unsuitable or unsafe.
Certified Adverse Weather: Only and exclusively in the event of adverse weather or sea conditions certified by the skipper in charge, the customer will be offered either an alternative date/time subject to mutual availability, or a full 100% refund of the amount paid.
5. Conduct Onboard
Guests must respect the vessel equipment, safety regulations, and all instructions given by the skipper and crew. Any behavior compromising passenger safety, crew operations, or maritime navigation will not be tolerated.
6. Cancellation, Withdrawal, and No-Show Policy
Our excursions and boat tours are provided on a private and exclusive basis: upon booking confirmation, the vessel, qualified crew, and personalized galley preparation are reserved solely for your private group, and all subsequent booking requests for that time slot are declined. Therefore, the following strict terms apply:
1. Cancellation with more than 24 hours notice
For cancellations requested in writing at least 24 hours prior to the scheduled departure time, the customer is entitled to a 100% full refund of the amount paid.
2. Cancellation with less than 24 hours notice
For cancellations communicated with less than 24 hours notice prior to departure, no refund will be issued (100% cancellation penalty).
3. No-Show (Non-appearance or arrival delay exceeding 20 minutes)
A situation of No-Show occurs, resulting in a 100% penalty of the total booking cost (no refund), in any of the following circumstances:
- Failure of the guest to present themselves at the agreed boarding dock at the scheduled departure time;
- Arrival delay exceeding 20 minutes from the agreed meeting time;
- Inability or failure of the guest to reach the meeting point or boarding location due to personal, third-party, or logistical circumstances (including, without limitation: traffic congestion, flight/train delays or cancellations, taxi delays or strikes, parking difficulties, personal health or schedules).
Because this is an exclusive charter reserved with dedicated dock mooring slots and customized provisioning, inability to attend due to customer-side causes does not constitute non-performance by the operator and gives no right to compensation or payment chargebacks.
7. Applicable Law and Jurisdiction
For any dispute arising out of or related to the interpretation, validity, or execution of these Terms and Conditions, the Court of Sassari (SS), Italy shall have exclusive jurisdiction.
